If divorced, you must know the date the divorce became final. Some
counties require a certified copy of the Final Judgment of Dissolution.
Please check with the Clerk of Court in the county you are
applying for a marriage license. Proof not required if widowed.
There is a three day waiting period after issuance of the marriage
license. For example, if you are to be married on Saturday, you must
obtain the marriage license before Wednesday of the prior week for it to
be valid. Couples who reside in another state or country, and come to Florida
to get married, are exempt from this provision.
If you want to avoid the delay in the license requirements, couples
must register and complete a four hour counseling course prior to obtaining
the marriage license. If you obtain counseling, the filing fee will
be reduced by $32.50 and there is no waiting period.

Is a marriage ceremony performed by a notary public of the State of Florida
"legal and binding"? - Yes.
Are witnesses required to sign the marriage certificate? - Although the marriage
certificate has spaces for two witnesses to sign, they are not specifically
required by law. However, it is recommended that two witnesses, other
than the notary, sign the marriage certificate in the event that proof of
the marriage ceremony is necessary in the future.
Can a notary public perform wedding ceremonies in any county in the State
of Florida? - Yes. A Florida marriage license is good in any county
in Florida.
Can a notary perform a marriage ceremony while aboard a ship? - Yes, as long
as the ship is in Florida waters at the time of the ceremony. The legal
definition of "Florida waters" is three geographic miles from the coastline
seaward on the Atlantic Ocean and nine geographic miles from the coastline
seaward on the Gulf of Mexico.
Can we get married first, and then get a license? - No, a marriage license
must be issued before the ceremony.*
